How do I pay for my legal fees?

We only work with solicitors who will provide their services on a ‘No win No fee’ basis. The ‘No win No fee’ arrangement is otherwise known as a Conditional Fee Agreement (CFA) and means that you will not have to pay for your solicitors costs or your opponents costs if the claim is successful. Your solicitor will recover most of their costs from your opponent and any shortfall may be deducted from any compensation you receive.

However, if you lose your claim the ‘No win No fee’ agreement usually means that your solicitor will take out an insurance premium which will pay for your opponents costs and any disbursements if you lose your claim. You will also not have to pay your own solicitors costs. It is important to be aware, that the ‘No win No Fee’ agreement will only apply if you have been truthful and have co-operated with your solicitors.

What is the law?

Under the Landlord and Tenancy Act 1985, your landlord has an obligation to keep your property in good repair. However, the same act also imposes a duty on your landlord to make good any disrepair in the property. Not all disrepair is covered by the act but we and our specialist solicitors can advise you on the types of disrepair that you can claim for.

Can I be evicted?

If you are living in council or social housing then you cannot be evicted for making a disrepair claim. You can only be evicted if you breach the terms of your tenancy agreement with the landlord. For example, if because of the disrepair you stop paying rent this failure to pay the rent, despite the state of the property, can amount to a breach of the tenancy. In those circumstances, you would give your landlord cause to evict you so it is important to keep up those rent payment even though the property is in disrepair.
